Artificial Intelligence: AI models become a new frontier for export controls
The Anthropic case marks a turning point
In June 2026, Anthropic found itself at the center of an unprecedented decision by the U.S. Department of Commerce. The company was instructed to restrict access for certain foreign nationals to two of its AI models, Claude Mythos 5 and Claude Fable 5, on the grounds that such access could constitute a deemed export under the Export Administration Regulations (EAR).
Unlike traditional export control cases involving physical products or software transfers, the issue here concerned access to AI technologies by individuals located within the United States.
Restrictions lifted after enhanced security measures
A few weeks after the initial decision, the Department of Commerce lifted the restrictions following the implementation of additional security measures by Anthropic.
Although temporary, the case demonstrates the growing attention U.S. authorities are giving to artificial intelligence technologies and the way access to these technologies is managed.
