United States: AI Action Plan and Its Direct Impact on Export Control

On July 23, 2025, the U.S. government released its national AI Action Plan together with Executive Order 14320 dedicated to promoting the export of American artificial intelligence technologies. This marks a significant shift in how AI technologies will be regulated under U.S. export control rules.

The new Executive Order provides official guidance for companies that develop, train, or deploy AI systems. It also prepares the ground for the upcoming revision of the U.S. Export Administration Regulations (EAR), expected since May 2025. The objective is clear: to strengthen national security by improving oversight of sensitive AI capabilities.

In practice, the plan outlines tighter controls over critical AI technologies, including advanced models, training processes, and the hardware used to develop them. Organizations exporting AI algorithms, software, datasets, or technical components will face new licensing considerations and stricter compliance reporting. Failure to comply may result in enforcement actions, financial penalties, or export restrictions.
